Tiger Kloof School - Governing Body Constitution

This Constitution is subject to the requirements and conditions as laid down in the South African Schools Act of 1996.

1.           Name

The governing body shall be known as “The Governing Body of Tiger Kloof Secondary School”.

2.           Aims and objectives

2.1         To further the interests, well-being and education of learners enrolled at the school.

2.2         To foster co-operation and sound relationships among parents, learners, teachers, and non-staff, with the Board of Tiger Kloof, and between the immediate school community and residents of the school’s catchment area.

2.3         To perform such acts and functions as may be necessary to attain the above aims and objectives, and to account to all parents, learners, teachers, and non-teaching staff for such acts and functions in a democratic and transparent manner.

2.4          To abide by the vision set out in the Mission Statement of the Governing Body and displayed publicly in the School’s office.

3.             Activities of the Governing Body

The Governing Body shall perform such activities as are necessary in terms of the powers and duties assigned to it in the Act or in the regulations which may be laid down by the Department of Education of the North West Province.

4.             Liability of member of the Governing Body

A member of the Governing Body will not be liable for any debt, damage or loss incurred by the School unless he or she acted without authorization or with malicious intent, in which case he or she may be held responsible for such debt, damage or loss.

5.             Financial arrangements

5.1           Two members of the Governing Body should be elected as signatories for payments out of school funds.

5.2           Tiger Kloof Secondary School is a public school on private property.  The Board of Directors of Tiger Kloof Educational Institution, a Section 21A Company, owners of the private property, assists the School with financial management.

5.3           The Governing Body of Tiger Kloof Secondary School will, through its finance committee, control school funds in conjunction with the Institution.

6.             Procedures for meetings

6.1           An extraordinary meeting of the Governing Body may be convened by the chairperson when he or she deems it necessary or when at least four members submit to the chairperson a written request for such a meeting, containing heir reasons for this request.

6.2           Ordinary and extraordinary meetings will take place after written notice of the meeting has been issued to all members at least seven days prior to the meeting. The notice of the meeting must include a list of the matters to be discussed.

6.3           The Governing Body will deal with matters of which prior notice has been given, and will deal with other matters provided that approval of the meeting is obtained.

6.4           Any person may attend and speak at a meeting of the Governing Body, provided that approval of the meeting is obtained.

6.5           Each member of the Governing Body has one vote.  At the conclusion of voting, the chairperson will exercise a casting vote if necessary.  This said, the Governing Body will first seek to resolve matters by consensus.

6.6           The minutes of any meeting will be read or taken as read at the opening of the next meeting, and if approved will be signed by the chairperson and the secretary. 

6.7           Matters of standing orders and procedures at meetings not covered by the Act, the regulations, or in this constitution will be decided by the chairperson.  Should any member question such a decision, the matter will be submitted to the meeting, without further discussion, for discussion and resolution.

7.            Amendments

7.1           A decision to amend this Constitution will require a two-thirds majority of the total membership of the Governing Body after all members have been informed on such proposed amendment(s) in writing at least two months in advance.

7.2           If too few members are present at the meeting convened for this purpose, a second meeting will be called exclusively for this purpose at least two weeks after the first meeting. If two-thirds of the members are not present at this second meeting, the proposed amendment(s) may be effected by two-thirds of the members present.

7.3           All amendments to this Constitution will be submitted to the Department for confirmation that they are consistent with the provisions of the Act and the regulations. Until such confirmation is received, no amendment to this Constitution shall be valid.

MISSION STATEMENT OF THE GOVERNING BODY OF TIGER KLOOF SECONDARY SCHOOL

The Governing Body of Tiger Kloof Secondary School, recognising the religious character of the school, commits itself to: -

-           uphold and observe the religious principles, values and beliefs set forward by the owner (Board) of this private

            property;

-           help, guide and give our undivided support to the principal, educators and other staff at the school in the

            performance of their professional functions;

-           provide exemplary leadership for the good governance of the school and for both the comfort and advancement

            of educators, support staff and learners;

-            promote and encourage responsible and timeous fee payments by the parents of the school

-           ensure a sustained contribution to the community by supporting Adult Training and Community Service programmes

-           adopt a constitution and code of conduct which are consistent with the legislation passed by Parliament

            (National and Provincial) from time to time;

-            administer and control all movable and immovable property, including money to the best of our skills,

             knowledge and abilities in conjunction and agreement with the Board and the North West Education Department;

-            determine an admission policy which does not unfairly discriminate against anyone who intends studying

             at the school;

-            recommend to the Department of Education, the appointment of educators and staff of high quality

             through transparent processes of recruitment and selection;

-            implement all transformation policies in education within the school as prescribed in the applicable legislation
